A lot happens during probate, the court-controlled process a will must go through before it is implemented. Ideally, it should be a smooth process of passing over a decedent’s estate per their wishes.
However, things don’t always work out as anticipated. If you are not careful, some or all of your inheritance may end up in the wrong hands. Therefore, it is prudent as a beneficiary to stay on top of things during probate and secure your estate. Here are some of the ways you can do this.
Get involved
Do not sit back and wait for the probate process to run its course. Get a copy of the valid will and familiarize yourself with how everything works in the probate process, from the valuation of the estate to the repayment of outstanding dues.
Remember to keep an eye on the estate assets and how they are being administered. The executor may be in charge of managing the estate, but you can provide an oversight role as a beneficiary. It will be easier to protect your interests if you take a proactive stance during probate.
Do not ignore red flags
Should you notice anything amiss, do not shrug it off. It could point to a bigger problem that could negatively affect your inheritance. Given the high stakes involved, the sooner you take action, the better. For instance, taking appropriate action immediately after you notice signs of executor misconduct can go a long way in protecting your inheritance.
Seek legal help
It’s better to be safe than sorry. You never know what issues will come up during probate. As such, you should strongly consider having legal representation to help you understand what to expect and how best to respond to any situation that arises.
