Navigating probate fights concerning pets

Probate disputes involving pets are becoming increasingly common, as many people consider their pets to be family members and work to safeguard their well-being in the event that they might outlive their owners. 

In Oklahoma, probate fights concerning pets typically arise when there is disagreement among the loved ones of the deceased over who should take custody of an animal, or if the deceased left conflicting instructions about the pet’s care or finances. 

When concerns arise 

Pets are legally considered property in Oklahoma, so they can be addressed in a will or estate plan, just like other personal belongings. However, this classification can create challenges when family members have strong emotional attachments to a pet and/or disagree on the best plan for its future care. Conflicts often arise when:

  • Mediation: An impartial mediator helps a family discuss and agree on a solution that considers both a pet’s best interests and the family’s wishes.
  • Trusts for pets: A pet trust can provide clear instructions and funds for a pet’s care, helping to prevent disputes by establishing a legally binding arrangement.
  • Court intervention: If family members cannot reach an agreement, the court may ultimately decide who will take custody of a pet.
