$100 Million Class Action Settled by Mitchell & DeClerck

Mitchell DeClerck is pleased to announce a $100 million class action settlement against Pilgrim’s Pride. This brings Mitchell DeClerck’s recoveries to over half a billion dollars in numerous class actions in the last decade.

This resolves a complex nationwide class action on behalf of over 24,000 farmers who grew broiler chickens for five defendant chicken “integrators” including Tyson, Sanderson Farms, Perdue, and Koch Foods. US District Judge Robert J. Shelby of Utah approved the settlement in the US District Court for the Eastern District of Oklahoma bringing the total recovered against all five defendant integrators to $169 million.

The class action asserted various claims against the five defendants including violations of antitrust law to the detriment of the class of farmers. The case took eight years and was filed in 2017 by Mitchell DeClerck, the Hausfeld law firm of Washington, DC and Berger Montague of Philadelphia.
