3 reasons a beneficiary might file a lawsuit against an executor

The relationship between beneficiaries and executors is pivotal in probate and estate management. An executor plays a pivotal role, from managing assets to resolving outstanding debts. 

However, disputes can arise when the beneficiary perceives a deviation from the executor’s fiduciary duties.

1. Breach of fiduciary duty

One common reason for legal action is the executor’s alleged breach of fiduciary duty. Beneficiaries may claim that the executor has not acted in the estate’s best interests, potentially mishandling assets or distributing them unfairly.
